Terms of Service

By creating an account or using ByldMate, you agree to these Terms in full. If you do not agree, do not use the service.

ByldMate is currently in beta testing. It is provided for evaluation purposes and is a work in progress. This means:

• Features, pricing, availability, and functionality may change, break, or be removed at any time without notice.
• The service may experience downtime, bugs, data errors, or complete data loss.
• You must independently verify all figures, invoices, calculations, and client communications generated by ByldMate before relying on them or sending them to clients. ByldMate is a tool to assist your business processes, not a substitute for your own financial or professional judgement.
• You are solely responsible for maintaining your own backups of any critical business, job, or client data.

ByldMate is built using and hosted on Base44, a third-party no-code application platform. Base44 provides the hosting infrastructure and underlying technical services that power ByldMate. We are not responsible for outages, data handling practices, or service interruptions originating from Base44's platform itself, beyond our reasonable control.

To the maximum extent permitted by law, ByldMate is provided "as is" and "as available," without warranty of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

To the maximum extent permitted by law:

• ByldMate and its founder/operator will not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, lost data, or business interruption, arising from your use of or inability to use the service.
• Our total aggregate liability arising from or related to your use of ByldMate, for any cause whatsoever, will not exceed the total amount you have paid us in the twelve (12) months preceding the claim, or AUD $0 if you have not paid any fees (as is expected during the free beta period).
• This limitation applies regardless of the legal theory on which liability is claimed, whether contract, tort (including negligence), or otherwise.
• Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law that cannot lawfully be excluded. Where liability cannot be excluded but can be limited, our liability is limited to re-supplying the service or the cost of re-supply, at our option.

You retain ownership of all business, client, and job data you input ("Your Data"). You are solely responsible for the accuracy of Your Data and of any invoices, progress claims, or figures generated from it before they are sent to any third party, including your clients. ByldMate is not liable for financial loss arising from inaccurate data entered by you, calculation errors you did not verify, or invoices sent using incorrect information.

You agree to indemnify and hold harmless ByldMate and its founder/operator from any claims, damages, losses, or expenses (including legal fees) arising from your use of the service, your breach of these Terms, or your violation of any law or third-party right, including claims brought by your clients relating to invoices or communications you sent through the platform.

You agree not to use ByldMate for unlawful purposes, to send fraudulent or misleading communications, to attempt to reverse-engineer or resell the platform without permission, or to interfere with its security or operation.

We may suspend or terminate your account at any time during beta, with or without notice, including to discontinue the beta program entirely. You may stop using the service at any time.

These Terms may be updated at any time without prior notice while ByldMate is in beta. Continued use after changes constitutes acceptance.

These Terms are governed by the laws of Victoria, Australia, and subject to the exclusive jurisdiction of its courts.
